Documents required for obtaining permission under section 118 for Commercial Purpose

  1. Latest original copy of : – A. Jamabandi of the proposed land. B. Aks/ Tatima ( Duly verified by the concerned Kanungo) alongside field book of the proposed land.
  2. Copy of agreement entered into by the transferor and the transferee.
  3. Affidavit of the Transferor stating that he , after the proposed transfer ,will not become landless, and if so he will not claim any any benefit/ land under any scheme prepared for the benefit of landless persons in the state.
  4. No objection of all the co-sharer/ tenants of the Land proposed to be transferred in case of joint holding where a particulars Khasra No. or part thereof is proposed to be transferred in form of affidavit stating that he/she has no objection in case land is transferred to proposed transferee. This affidavit will not be required in any case of transfer of a share in an entire joint holding.
  5. Essentiality Certificate from the concerned department , for example If want to establish tourism unit in Himachal , you have to obtain essentiality certificate from Department of Tourism ( https://himachaltourism.gov.in/wp-content/uploads/2018/08/EC-Documents-new-guidelines.pdf ), for Industries ( https://himachalforms.nic.in/pdfs/Industry/ApplicationFormforObtainingEssentialCertificatesforPurchaseTransferofPrivateLand.pdf ).
  6. In case of non-agriculturist seeking to sell any land or building purchased after obtaining permission under section 118, proof of utilization for the purpose for which permission was obtained from the relevant department or local body concerned within the period allowed for utilization.
  7. Certificate regarding the balance land of the seller duly countersigned by the concerned Tehsildar.
  8. If built up house / flat is being purchased , then valuation report along with approved site plan.
  9. If build up house /flat is being purchased , then registration certificate of house or NOC from TCP Department
  10. If seller has attained land with the permission of Govt. under Section 118 of H.P. Tenancy & Land reform Act. 1972 then attested affidavit to the extent that after proposed transfer of the property . No claim will be made for any benefit of land etc. as landless person in the state.
  11. Copy of permission letter vide which the land was acquired.
  12. Attested Copy of Registration Certificate of the institution /company / society .
  13. Bye – laws / Memorandum and Articles of Association of the Institution / Company / Society .
  14. Affidavit of applicant that he / she has not earlier aquired any land for the same purpose in his name or in the name of his family with the permission of state Govt. Under clause (h) of sub section (2) of section 118.
  15. Preliminary project report.
