Restriction on Khangi Taksim for Plotting in Himachal Pradesh by Department of Revenue and H.P. RERA ( Govt. of Himachal Pradesh) .
It has come to the notice of the H.P. Real Estate Regulatory Authority that large number of Real Estate plotted projects are being carved out in the field by making Khangi Taksim by Revenue Officers. A case has come to the notice of HP RERA in which , nearly 50 plots were carved out in Distt. Mandi by making Taksim in the revenue records and it is clear that plots have been carved out without proving adequate road width , parking facilities or green spaces in the colony, Thus such colonies will become slum areas if , requisite facilities are not kept , by getting the map approved from the Town and Country Planning Department and getting the project registered with HP RERA.
Violation of Section -3 of the Real Estate (Regulation and Development) Act, 2016.
Section 3(1) of the RERA Act lays out that a promoter shall not advertise, market, book, sell or offer for sale, or invite persons to purchase in any manner any plot, apartment, or building in any real estate project or part of it, in any planning, development or municipal area, without registering the real estate project with the Real Estate Regulatory Authority (RERA).
Directions for Field functionaries ( Revenue Department ) and land owners.
The Principal Secretary ( Revenue) and Chairman HP RERA directed the field functionaries that while carrying out Khangi Taksim , it may be ensured that such partition is not intended for plotting the partitioned area to evade from registration of project with RERA and the provision of section -3 of the RERA act may be complied with for plotting the area. If plots are being carved out after Khangi Taksim for Housing colonies, the owner should register their project with HP RERA for land areas more than 500 Sq. Meters ( or more than 8 apartments ) within the planning areas and land area more than 2500 Sq. Meters outside the planning areas.
Direction issued by The Principal Secretary ( Revenue ) to all the Deputy Commissioners in Himachal Pradesh regarding concerned matter.
