Key points to check in Bayana Agreement by Buyer as well as Seller.

When Seller and Buyer ( both parties ) are ready for Bayana Agreement. In this case both parties or specially buyer should be alert for each heading and terms which are writing in Bayana agreement , if any flaw will occur in Agreement , in this case Bayana Agreement should consider null and void.

Key points to check

A ) Presence of owner or GPA holder during Bayana Agreement Process.

This is most important step in entire process, on the day of Bayana Agreement each and every shareholder ( who are willing to sell ) of land should be present or their authorized person ( should be in written form ). Buyer and buyer’s agent should cross check that person present on Bayana Day would be the owner in revenue record.

Owner – Name mentioned in Jamabandi ( Land record ) till date.

GPA Holder – General Power of Attorney holder on behalf of owner(s).

B) Cross check the exact Khata No. Khatuni No. Khasra No. and Mohal of concerned land .

Cross check each detail of land Tehsil , Mohal , Khata No. Khatauni No. Khasra No. of concerned land with Bayana Agreement and Jamabandi ( Revenue paper ) . If any technical mistake occur, this can make Bayana Agreement null and void.

C) Write down exact land measurement.

If seller possess five kanal land and wants or agrees to sell one kanal land in that particular share. Both parties ( Buyer and seller ) have to check the details of land measurement that should be written on Bayana agreement. If any flaw in land measure occur , can lead to dispute and agreement should be null and void.

D) Percentage of money transaction during Bayana Agreement

There is no specific percentage and amount defined in any rule book . Its only depend upon the need, pauing capacity of intened buyer and negotiation during Bayana Agreement. It is advised to negotiate to pay or receive the bayana amount according to your need or requirement.

E ) Pay heed to duration of Bayana .

Bayana agreement says that exactly after the end of mentioned duration both parties have to enter into sale deed ( Registery process ). So purchaser has to request for duration as per his /her convenient. So that purchaser would not make request for extension of duration with seller.
